The 2021 treaty changed everything
The Glücksspielstaatsvertrag 2021, the State Treaty on Gambling, replaced a fragmented and much-litigated system with a single national licensing gateway for online sports betting, poker and virtual slots.
Enforcement sits with the GGL, the joint gambling authority of the federal states, which is now the central German regulator for licensing and supervision.
Players are not taxed, mostly
Hobby players pay no income tax on winnings. The exceptions are narrow and worth knowing: sustained poker income across multiple years can be treated as commercial activity and taxed accordingly, and very large winnings from unlicensed operators can attract money-laundering scrutiny.
Operators carry the load instead. Land-based casino operators are exempt from ordinary corporate tax but pay on gross gaming revenue at rates that range between 20% and 80% depending on the state. Online sports betting, virtual slots and poker carry a 5.3% levy on stakes, which is charged on turnover rather than revenue and materially reduces what operators can return to players.
