Two layers of regulation
Spain splits regulation. Online gambling is national, overseen by the Dirección General de Ordenación del Juego, while land-based casinos, betting shops and bingo halls are licensed by each of the 17 autonomous regions under their own rules.
In practice that means the rules in Catalonia and Madrid are not identical, and a venue's obligations depend on where it sits.
Winnings are taxable, and losses count
Spain is unusual in Europe: net winnings from casino games, sports betting and poker must be declared as capital gains on the annual IRPF return and are taxed at progressive rates.
The compensating rule is that losses can be offset against winnings, but only if they are documented and only where the operator is DGOJ-licensed. Playing with an unlicensed operator removes the deduction while leaving the liability, which is the worst of both.
Keep records if you play seriously in Spain. It is one of the few places where that has a direct financial consequence.
